TERMS & CONDITIONS

  1. The promoter is Opticomm Pty Ltd (ABN 50 117 414 776) of Level 2, 2 Lonsdale Street, Melbourne VIC 3000, telephone 1300 137 800 (“Promoter”).
  2. The Promoter may engage with third party contractors to assist with the running of this offer. In relation to this offer, iGoDirect Pty Ltd is involved and may appear in correspondence, or have direct contact with, any claimants.
  3. Any changes to these Terms and Conditions will be published on our website at opticomm.com.au/reconnect. It is the claimants’ responsibility to check these Terms and Conditions for updates.
  4. Instructions on how to claim and the Rewards form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
  5. Claims are only open to Australian residents aged 18 years or over who live in an area where Opticomm service is available. To check if an Opticomm service is available and that you are eligible to claim, visit the Opticomm website at: https://online.telco.opticomm.com.au/.
  6. Employees (and their immediate families) of the Promoter, Participating Service Providers (defined below) and agencies associated with this offer are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  7. The offer commences on 01/11/25 and closes at 11:59pm AEDT on 31/01/26 (“Offer Period”). The Offer Period may be extended at Opticomm’s sole discretion and without prior notice.
  8. A participating service provider is any retail service provider in Australia that offers Opticomm service plans at a claimant’s property during the Offer Period (each a “Participating Service Provider”).
  9. To be eligible to claim and receive a Reward, individuals must, during the Offer Period:
    1. Purchase any Opticomm service plan from a Participating Service Provider (“Eligible Service Plan”);
    2. Register by completing the following steps;
      1. Click the registration link within the promotional email; or
      2. Visit opticomm.com.au/reconnect and register for the offer by inputting the postal address linked to your Eligible Service Plan and creating a password.
    3. Have an active Opticomm service for a minimum of ninety (90) days. Once a claimant has reached the ninety (90) day minimum period, the claimant will be notified by the Promoter and sent their Reward.
    4. For clarity, the claimant will continue to be charged the applicable rate under the Eligible Service Plan, and where cancellation is sought, the claimant must do so directly with the applicable Participating Service Provider. Claimants are ineligible to receive the Reward if service is cancelled prior to the 90-day period, or period as otherwise explicitly advertised by Opticomm in writing.
  10. A claimant will receive their Reward after ninety (90) days from the start of an active Eligible Service Plan. For clarity, this date may extend beyond the Offer Period close date.
  11. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the offer. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  12. The Promoter may, in its absolute discretion, deny any claim for a Reward made by a claimant where it is reasonably deemed as invalid and the claimant will forfeit any right to a Reward.
  13. Incomplete or indecipherable claims will be deemed invalid.
  14. Multiple claims permitted, subject to the following:
    1. only one (1) claim is permitted per Eligible Service Plan that is used for a minimum of ninety (90) days;
    2. a maximum of one (1) claim per household; and
    3. each registration form must be submitted separately and in accordance with the registration requirements.
  15. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  16. Every valid claimant who uses an Eligible Service Plan for a minimum of ninety (90) days will be awarded one (1) AUD$100 Visa Digital Gift Card (“Reward”).
  17. The Visa Digital Gift Card is issued by iGoDirect Group Pty Ltd and separate terms and conditions apply. In order to activate a Visa Digital Gift Card, individuals must: a) have a mobile device which supports Apple Pay or Google Pay; b) be in Australia with location services enabled on your mobile device; and c) agree to any applicable terms of use, privacy policy and/or any other terms of Apple Pay or Google Pay. Visa Digital Gift Cards are valid for the period advertised on the Visa Digital Gift Card and in the email containing the Visa Digital Gift Card, and will expire on the date indicated on the face of the Visa Digital Gift Card. After the Visa Digital Gift Card has expired, it is no longer valid, and all transactions will be declined. The Promoter is not liable for a claimant’s failure to utilise the Reward before the expiration date.   18. Successful claimants will be sent their Reward via email and SMS.
  19. The Promoter’s decision is final, and no correspondence will be entered into.
  20. If for any reason a claimant does not redeem a Reward by the time stipulated by the Promoter, then the Reward will be forfeited.
  21. If any Reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the Reward with a Reward to the equal value and/or specification.
  22. Rewards, or any unused portion of a Reward, are not transferrable or exchangeable and cannot be taken as cash, unless otherwise specified.
  23. In the event of war, terrorism, state of emergency, government lockdown, pandemic or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a Reward.
  24. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this offer (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  25. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
  26. Any cost associated with accessing the registration website, or any other website related to the offer, is the claimant’s responsibility and is dependent on the internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically register or claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.
  27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
  28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a Reward.
  29. The Promoter collects personal information ("PI") in order to conduct the offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Reward suppliers and, as required, to Australian regulatory authorities or as otherwise required by law. Participation is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.opticomm.com.au/legal/privacy-policy/. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. By participating in this offer, claimants acknowledge and agree that PI may be disclosed to entities located overseas. The Promoter will only use and disclose personal information in accordance with the Privacy Act and the Australian Privacy Principles. This may include where the Promoter has the claimant consent to use or disclosure, or for the purpose for which it was collected or related purposes that you would reasonably expect the Promoter to use or disclose that information.
